Compensation & personal injury lawyer in Wrocław
A road accident, medical malpractice, a workplace incident: each gives rise to a claim for damages and compensation for suffering. Polish law protects injured parties broadly, but insurers rarely volunteer full payment. I handle these cases from the first letter through to a court judgment.
Damages vs. compensation for suffering
These are two separate heads of claim. Damages cover financial loss: medical costs, rehabilitation, lost earnings, damaged property. Compensation for pain and suffering covers non-financial harm: pain, distress, permanent disability. In serious cases a pension for increased needs or lost earning capacity is also available. I pursue all heads together to achieve full redress.
Road accidents and third-party liability (OC)
Most compensation after road accidents is paid by the at-fault driver's insurer under Polish compulsory OC cover. In practice, first offers from insurers are often significantly below what is due, especially for pain and suffering and future-needs pensions. I review the offer, negotiate with the insurer and take the case to court when needed.
Medical malpractice and workplace accidents
Patients harmed by medical malpractice and employees injured through an employer's fault are also entitled to compensation. These cases require working with medical records, expert witnesses and specific liability rules; I handle them for clients throughout Lower Silesia and beyond.
Frequently asked questions
How long do I have to claim compensation after an accident in Poland?
As a rule three years from the day you learned of the harm and the party responsible. For accidents involving a criminal offence the limitation period is twenty years. The clock runs regardless of any parallel criminal proceedings.
The insurer has made me an offer. Do I have to accept it?
No. Signing a settlement closes your claim; later recovery becomes very difficult. Before you sign, it is worth checking whether the amount offered is appropriate: initial offers are frequently below what is due.
Can I claim if I partly contributed to the accident?
Yes: contributory negligence reduces but does not eliminate compensation, in proportion to your degree of fault. Even partial own-fault cases are worth assessing.
How do I fund medical costs while waiting for compensation?
The insurer is obliged to pay an advance for treatment costs without waiting for the whole case to conclude. You can also apply to the court for an injunction securing the claim.
